What’s the impact for manufacturers?
Many manufacturers are asking themselves this question. Despite its somewhat misleading name, the tertiary sector eco-energy decree does indeed concern a majority of manufacturers.
The tertiary sector eco-energy decree mandates that tenants and owners of tertiary sector buildings, or parts thereof, with a surface area of 1,000 m² or more must monitor and reduce their energy consumption:40% in 2030, 50% in 2040 and 60% in 2050 compared with a reference year.
Initially scheduled for September 30, 2021, the first deadline was postponed by one year by the Ministry of Ecological Transition. The process includes submitting energy consumption data to the OPERAT platform (Observatory for Energy Performance, Renovation, and Actions in the Tertiary Sector), which is managed by ADEME.
Manufacturers are also targeted by this scheme for administrative buildings (office space, etc.) and logistics buildings.
In fact, the text specifies that the following are concerned:
- All sections of a mixed-use building that accommodate tertiary activities such as offices, storage areas, etc. with a total floor area of 1,000 m² or more;
- Any group of buildings located on the same plot or site that collectively accommodate tertiary activities with a total floor area of 1,000 m² or more.
What are the objectives?
The aim is to reduce the final energy consumption of the tertiary sector by at least:
- – 40% by 2030
- – 50% by 2040
- – 60% by 2050
compared with the most recent reference year chosen.
What are the penalties?
If the targets are not met, the state is counting on image-related sanctions. As a result, any organization that fails to update its data on the platform or does not meet its targets will be publicly listed online under a Name and Shame policy. This may be accompanied by a fine of up to €7,500 per building.
How to prepare for it?
This decree is seen as a constraint for manufacturers. But it can be a genuine opportunity: reduced energy costs, competitive edge, commitment to the energy transition, etc.
It’s important to anticipate what needs to be done before the earliest deadline. Beyond merely collecting data, it is essential to monitor and analyze the energy consumption of the relevant tertiary premises to demonstrate progress and ensure that established targets are being met.
