Effective since October 1, 2019, the Tertiary Energy Efficiency Decree requires a gradual reduction in the final energy consumption of existing tertiary buildings. It applies to owners and managers of commercial buildings with a floor area in excess of 1,000 m². Temporary buildings, places of worship, civil security and homeland security buildings are not affected.

Control your energy consumption to achieve your objectives
Companies can choose the method of calculating targets, depending on what best suits their needs and the specifics of their business. This choice therefore determines the reduction levels to be achieved.
- The absolute value sets a specific consumption threshold for each type of building. This threshold is calculated on the basis of reference usage intensity indicators adjusted according to climatic conditions. This method is ideal for new or already efficient commercial buildings.
- The relative value is based on a percentage reduction in consumption compared to the selected reference year from 2010 to 2020 -40% by 2030, -50% by 2040, and -60% by 2050. This method is particularly suitable for high-consumption or older buildings.
Companies subject to the decree must disclose their annual consumption on the OPERAT platform. Each year, OPERAT generates an energy consumption certificate adjusted for climatic variations, which positions the buildings in relation to the targets set by the decree.
Stay ahead of requirements, avoid penalties
Non-compliance with these requirements can result in sanctions, including formal notices and public disclosure on a government website (“Name and Shame”). Financial penalties may also be applied, up to €1,500 per building for individuals, and €7,500 for corporate bodies.
